Schneiderman Again Rebuffs Congressional Subpoena

By Dan Freedman

New York Attorney General Eric Schneiderman rebuffed yet another subpoena from a Republican-controlled House committee looking into his fraud inquiry involving energy giant ExxonMobil and climate change.

"There can be no 'legitimate congressional oversight' of a state law fraud investigation," Schneiderman, a Democrat, said in a letter Wednesday addressed to Rep. Lamar Smith, R-Texas, chair of the House Science, Space and Technology Committee. "The committee chose to pursue (and now to continue) this course, despite the lack of any precedent for such action in our nation's recorded history."

The subpoena, issued to Schneiderman last month, was the latest chapter in Smith's investigation of Schneiderman's investigation. The House probe is aimed at finding out whether the state attorney general's probe is effectively squelching free-speech rights of scientists at ExxonMobil who may have legitimate differences with the scientific consensus that rising temperatures and greenhouse gases are indeed the product of fossil-fuel burning and other human activity.
