New York State Neuroscientist Pleads Guilty to Funneling Funds to Supplier That Paid Him More Than 70K

 
New York State Inspector General Letizia Tagliafierro today announced that Dr. Gerwin Schalk, a research scientist with the New York State Department of Health’s (DOH) Wadsworth Center in Albany and deputy director of the National Center for Adaptive Neurotechnologies (NCAN), pled guilty to charges that he accepted more than $70,000 in illicit payments from a neurotechnology supplier while steering federal grant funding to the company – and then covered up the payments.

“Dr. Schalk abused his high-profile state position by using public funds to purchase neurotechnology products from a company that was paying him a handsome sum on the side,” said New York State Inspector General Tagliafierro. “Through his elaborate scheme, he lied, failed to disclose conflicts of interest and ultimately broke the public’s trust. I applaud the U.S. Attorney’s Office for the Northern District for working to ensure he will no longer be able to unscrupulously enrich himself.”

United States Attorney Grant C. Jaquith stated: “Gerwin Schalk specializes in cutting-edge neurology research, but he failed to honor some of his most basic obligations as a state employee and federal grant recipient. He lined his pockets with at least $70,000 in payments from a company whose products he used in his research, and then repeatedly lied about this brazen conflict of interest. His guilty plea demonstrates that even acclaimed researchers must follow the rules, and that we and our law enforcement partners are committed to safeguarding the integrity of federally funded research.”

Schalk pled guilty today before Hon. Lawrence E. Kahn in U.S. District Court for the Northern District of New York to submitting materially false conflict of interest certifications (18 U.S.C. § 1001(a)) in relation to federal grants administered by the National Institutes of Health (NIH). Schalk admitted to all the conduct outlined in the criminal complaint filed against him in August and agreed to repay the illicitly received funds. He also resigned from state employment. Schalk is due back in court April 30, 2020 for sentencing.

A joint investigation between the Inspector General’s office, the U.S. Attorney’s Office for the Northern District of New York, and the U.S. Department of Health and Human Services’ Office of Inspector General (HHS-OIG) revealed Schalk, 48, of Glenmont, accepted at least $70,000 in payments from a neurotechnology supplier whose products Schalk regularly used in his research. At the same time, Schalk, as the principal controlling federal grants for the research, steered a grant administrator working with DOH to deliver approximately $260,000 in federal funds to the company.

The company’s payments to Schalk were primarily made via wire transfers and PayPal deposits over a five-year period.

To cover up the scheme, Schalk: falsely stated to the grant administrator that he did not receive any financial benefit from any entity involved in his research; failed to inform DOH that he was being compensated by the company – in violation of DOH policy; and failed to disclose the payments on his required annual Financial Disclosure Statements (FDS) with the Joint Commission on Public Ethics (JCOPE).

Inspector General Tagliafierro thanked United States Attorney Grant Jaquith, HHS-OIG, and the Bethlehem Police Department for their assistance with the investigation and arrest.

In Memoriam: Lieutenant Thomas J.E. Crotty

 
Had Been Listed MIA Since 1942 After the Surrender
of Corregidor in the Philippines During World War II
 
Governor Andrew Cuomo today directed flags on all State government buildings to be flown at half-staff on Saturday, November 2, in honor of World War II U.S. Coast Guard Lieutenant Thomas J.E. Crotty of Buffalo. Lieutenant Crotty was reported MIA and later died at the Cabanatuan POW camp in the Philippines in July 1942. His body will be repatriated to the United States and interred at Holy Cross Cemetery in Buffalo on November 2.

"We all owe a debt of gratitude to Lieutenant Crotty for his service and making ultimate sacrifice while defending our country to ensure freedom for future generations of New Yorkers," Governor Cuomo said. "To honor Lt. Crotty and his legacy as he is finally and rightfully returned home to Buffalo, I am directing flags to half-staff on all State buildings and on behalf of all New Yorkers, I express our sincerest appreciation for his service."

Lieutenant Crotty played a key role in destroying supplies and facilities to prevent them from falling into enemy hands when the U.S. Navy abandoned its main Naval Base in the Philippines following the Japanese invasion in 1941.

Lieutenant Crotty served with the 16th Naval District-in-Shore Patrol Headquarters aboard the USS Quail in the Philippines. When the Japanese invaded the Island of Corregidor in May 1942, Crotty led a team of Marines and Army personnel firing on Japanese soldiers landing on the island's beach. After the surrender of Corregidor, Lieutenant Crotty and thousands of service members were held at the Cabanatuan POW camp. He was the only Coast Guardsman taken prisoner during World War II. On July 19, 1942, at thirty-years-old, Lieutenant Crotty was killed in action and buried in a mass grave with fellow prisoners.

In the decades since the war, the American Graves Registration Service has exhumed and examined the remains of thousands of fallen soldiers to identify them. Using mitochondrial DNA analysis, Lieutenant Crotty's remains were identified on September 10, 2019, and will be sent home to the United States, arriving at the Niagara Falls Air Reserve Station on November 1.

Ukrainian Congress Committee of America: On Disloyalty

 
Throughout our nation’s history, the most prominent examples of the disloyalty charge in the United States have come in the midst of major world conflicts. In the years leading up to World War II, anti-immigrant voices in the media would paint Europe’s fight against genocidal totalitarianism as little more than a “Jewish cause,” alleging that Jews in this country sought to involve America in foreign wars against the nation’s true interest. Similarly, when Joseph Stalin began to forcibly starve Ukrainians in the genocide of 7-10 million Ukrainians - remembered today as the Holodomor - Ukrainian Americans were dismissed as liars who sought to create a conflict with the Soviet Union, right at the moment the United States began normalizing diplomatic relations with the USSR.
 

On the evening of October 28, Lieutenant Colonel Alexander Vindman, a U.S. Army foreign area officer wounded and decorated for his service in Iraq, released to the press his opening statement to Congress. A member of President Trump’s National Security Council since 2018, out of a “sense of duty” Lt. Col. Vindman had twice registered his concerns about this administration’s improper demands of Ukraine, a strategic ally of the United States.
 

This brave public servant came forward to the people’s house, the U.S. Congress, guided by his conscience, as it had all of his life. This act of individual courage reminds us that truth and justice remain ideals that Americans still yearn to live by.
 

And yet, the character of Lt. Col. Vindman was immediately called into question by anti-immigrant voices in the media. This is unacceptable in a country made up of immigrants, and should be strongly rejected.
 

Chief among the media’s charges was that Lt. Col. Vindman was known to have spoken in the Ukrainian language with Ukrainian diplomats. Combined with his birth in the Ukrainian S.S.R., this immigrant, who serves the United States dutifully, is being accused of disloyalty.
 

The Ukrainian Congress Committee of America (UCCA), the largest representative organization of Americans of Ukrainian descent, unequivocally condemns this smear campaign against an American war hero.
