Politics in Action: H.R. 5293 & H.R. 5053

STATEMENT OF ADMINISTRATION POLICY
H.R. 5293 – Department of Defense Appropriations Act, 2017
(Rep. Rogers, R-KY)

The Administration strongly opposes House passage of H.R. 5293, making appropriations for the Department of Defense for the fiscal year (FY) ending September 30, 2017, and for other purposes.

While the Administration appreciates the Committee's support for certain investments in our national defense, H.R. 5293 fails to provide our troops with the resources needed to keep our Nation safe.  At a time when ISIL continues to threaten the homeland and our allies, the bill does not fully fund wartime operations such as INHERENT RESOLVE.  Instead the bill would redirect $16 billion of Overseas Contingency Operations (OCO) funds toward base budget programs that the Department of Defense (DOD) did not request, shortchanging funding for ongoing wartime operations midway through the year.  Not only is this approach dangerous but it is also wasteful.  The bill would buy excess force structure without the money to sustain it, effectively creating a hollow force structure that would undermine DOD's efforts to restore readiness.  Furthermore, the bill's funding approach attempts to unravel the dollar-for-dollar balance of defense and non-defense funding increases provided by the Bipartisan Budget Act of 2015 (BBA), threatening future steps needed to reverse over $100 billion of future sequestration cuts to DOD.  By gambling with warfighting funds, the bill risks the safety of our men and women fighting to keep America safe, undercuts stable planning and efficient use of taxpayer dollars, dispirits troops and their families, baffles our allies, and emboldens our enemies.

In addition, H.R. 5293 would impose other unneeded costs, constraining DOD's ability to balance military capability, capacity, and readiness.  The Administration's defense strategy depends on investing every dollar where it will have the greatest effect.  The Administration's FY 2017 proposals would accomplish this by continuing and expanding critical reforms that divest unneeded force structure, balance growth in military compensation, modernize military health care, and reduce wasteful overhead.  The bill fails to adopt many of these reforms, including through measures prohibiting the use of funds to propose or plan for a new Base Realignment and Closure (BRAC) round.  The bill also continues unwarranted restrictions regarding detainees at Guantanamo Bay that threaten to interfere with the Executive Branch's ability to determine the appropriate disposition of detainees and its flexibility to determine when and where to prosecute Guantanamo detainees based on the facts and circumstances of each case and our national security interests.

In October 2015, the President worked with congressional leaders from both parties to secure the BBA, which partially reversed harmful sequestration cuts slated for FY 2017.  By providing fully-paid-for equal dollar increases for defense and non-defense spending, the BBA allows for investments in FY 2017 that create jobs, support middle-class families, contribute to long-term growth, and safeguard national security.  The Administration looks forward to working with the Congress to enact appropriations that are consistent with that agreement, and fully support economic growth, opportunity, and our national security priorities.  However, the bill is inconsistent with the BBA, and the Administration strongly objects to the inclusion of problematic ideological provisions that are beyond the scope of funding legislation.  If the President were presented with H.R. 5293, the President's senior advisors would recommend that he veto the bill.

The Administration would like to take this opportunity to share additional views regarding the Committee's version of the bill.

H.R. 5053 – Preventing IRS Abuse and Protecting Free Speech Act
(Rep. Roskam, R-IL, and 25 cosponsors)

The Administration opposes H.R. 5053, the Preventing IRS Abuse and Protecting Free Speech Act, which would constrain the Internal Revenue Service's (IRS) ability to enforce tax laws and reduce transparency.

Current IRS rules generally require tax-exempt organizations, including section 501(c) organizations, to report the names and addresses of substantial donors (generally, donors of $5,000 or more) as part of their tax returns.  In addition, section 501(c)(3) private foundations and section 527 political organizations are required to make this contributor information publicly available.

H.R. 5053 would prohibit the IRS from requiring section 501(c) organizations to report this information with limited exceptions.  By permanently preventing the IRS from requiring reporting of donor information by 501(c) organizations, H.R. 5053 would constrain the IRS in enforcing tax laws and reduce the transparency of private foundations.

NYS Tax Dept Reminds Businesses of June 20 Sales Tax Filing Deadline

The NYS Tax Department reminds quarterly and monthly sales tax vendors to avoid penalties and interest by filing their returns on or before Monday, June 20, 2016.

More than 91% of sales tax filers use the Tax Department’s free online Sales Tax Web File service to ensure accurate and timely filings. Web filing is the most efficient way to file and is required for most businesses. For those who don’t already Web file, the first step is to create an Online Services account.

Vendors must pay penalty and interest charges if their returns are filed after the June 20 deadline, the amount due isn’t paid in full, or both. In addition, late quarterly filers will miss out on the vendor collection credit, which can be as much as $200. Vendors, including new business owners, must file by the deadline even if they didn’t make any taxable sales or purchases during the reporting period.

New York State has more than 536,000 sales tax filers, including about 227,000 quarterly filers and 49,000 monthly filers. Filing frequency depends on the amount of a business’s taxable sales or tax due, with most vendors required to file quarterly when they first register to collect sales tax.

In the 2015 calendar year, sales tax payments totaled more than $28 billion—revenue shared by New York State with the county or city where the sales occurred.

Cuomo And Lawmakers Strike Agreement On Heroin Legislation

Gov. Andrew Cuomo and the top lawmakers in the Senate and Assembly on Tuesday announced they had reached an agreement on a package of bills that are aimed at combating heroin and opioid addiction in New York.

The bills cover a range of issues, including strengthening insurance access for addiction treatment, provide better access to the treatment itself and considers prevention components.

“New York and the nation as a whole is grappling with how to combat heroin and opioid addiction and, with this comprehensive plan, we are continuing to take decisive action to end this epidemic and protect our families and communities,” Cuomo said in a statement.

“This multi-faceted legislative package will increase access to treatment, expand prevention strategies, and save lives by helping ensure New Yorkers struggling with addiction have access to the services and resources they need to get well. I commend Majority Leader Flanagan, Speaker Heastie and Senator Klein for their deep dedication to addressing this issue, and I look forward to our continued work to protect the health and safety of all New Yorkers.”

How Joseph Percoco, Cuomo’s Problem-Solver, Became a Problem

ALBANY — Theirs was a relationship built on nearly three decades of unswerving loyalty, absolute trust and near-constant interaction: It was all but impossible to imagine Gov. Andrew M. Cuomo without Joseph Percoco, his closest aide and the enduring mainstay of his life in politics.

It took only a few days to send it crumbling to the ground.

By the end of April, it had become clear that Mr. Percoco was in trouble. Federal investigators had subpoenaed records related to him from a state ethics board. Then, the governor learned that federal agents had raided Mr. Percoco’s home in Westchester County, looking for evidence that he and his wife had improperly received thousands of dollars from companies that had done business with the state.

Later, after some 72 hours of intense strategizing, the governor effectively cut ties with Mr. Percoco in a jarring public statement acknowledging that the actions of “some individuals” may have “defrauded the state.” Mr. Cuomo has been even more overt since then, repeatedly naming Mr. Percoco and another former aide, Todd R. Howe, as the prime targets of the investigation led by Preet Bharara, the United States attorney for the Southern District of New York.

Supreme Court Declines to Rule on What Makes a U.S. Citizen

The U.S. Supreme Court declined Monday to decide who becomes a US citizen at birth, in a case brought by a group of American Samoans.

Since 1900, American Samoa has been a territory of the United States. But unlike residents of other US territories, including Puerto Rico and Guam, its residents are declared by Congress to be "non-citizen nationals."

Accordingly, they cannot vote in U.S. elections, run for public office, or serve as officers in the U.S. military. Their passports are stamped "The bearer is a United States National and Not a United States Citizen."

Omar Mateen Probed for Terror Ties but Legally Purchased Weapons

How does a man investigated by the FBI for possible links to terrorism buy an assault-style weapon in America? Easily.

Omar Mateen used a legally purchased AR-15-style weapon to massacre at least 49 people in an Orlando gay club early Sunday. The FBI had looked into him twice with inconclusive findings — not that a different result necessarily would have mattered.

The American-born Mateen had security and firearm licenses and his guns were legally purchased within the past week.

In most states, people convicted of misdemeanor hate crimes may still legally purchase guns. That suspected terrorists can legally purchase weapons in the U.S. has been a fierce point of contention in Congress and among gun-control advocates.

Hillary Clinton Reacts to Orlando Shooting: I Won’t ‘Declare War’ on a Religion

The Orlando nightclub massacre is pushing the issues of national security and gun control to the forefront of the presidential race once again. Presumptive Democratic nominee Hillary Clinton, who called the shooting “an act of terror,” joins TODAY’s Savannah Guthrie to discuss the deadliest mass shooting in U.S. history. When asked about Republican rival Donald Trump’s criticism that she is not calling the shooting what it is, Clinton responded: “I think to me, radical jihadism and radical Islamism, I think they mean the same thing…I’m not going to demonize and demagogue and declare war on an entire religion.”

Trump Set to Address Terrorism, Clinton Record in Monday Speech

Donald Trump faces high stakes Monday — and possible political peril — with a much-touted speech criticizing Hillary Clinton's candidacy that will now also serve as his first public address since Sunday's deadly terror attack in Orlando.

"Mr. Trump's message isn't entirely about being tough, it's about being smart, vigilant and talking about the difficult subjects in order to produce common sense solutions for all Americans," Trump campaign manager Corey Lewandowski told NBC News in a preview of what to expect from the speech which the candidate will deliver at St. Anselm College in Manchester, New Hampshire.

"Mr. Trump is tough on terrorism because there should be no other option when it comes to the threats we face to our safety and freedoms. He is a leader for all and his message today emphasizes that."

One World Trade Center Honors Victims of Orlando Massacre

On June 12, Governor Andrew Cuomo directed the lights of One World Trade Center's 408-foot spire to be displayed in the colors of the pride flag in the wake of the horrific terrorist attack that took place in Orlando, Florida. New York stands in solidarity with the LGBT community and mourns the loss of the Americans whose lives were cut short by this senseless act of violence.

“From Stonewall to marriage equality to protecting transgender individuals to the first-in-the nation executive action to ban conversion therapy, New York has led the way in the fight for LGBT rights. In this state, we believe that no matter your race, creed, color, gender identity or expression you have the right live your life free from persecution and prejudice," said Governor Cuomo.

"This senseless act of terror reminds us that there are those who seek to undermine these very values and the progress we have achieved. We will not let this happen. An attack on one is an attack on all. New York joins the rest of the nation in rejecting this hate, fear and extremism and stands shoulder to shoulder with the LGBT community.

“Tonight, I am directing One World Trade Center to be lit the colors of the pride flag in a tribute to LGBT Americans and the lives that were lost. On behalf of all New Yorkers, I extend my deepest thoughts and prayers to those affected by this horrendous tragedy.”

AP: 'Albany One of the Nation's Most Crooked State Capitals'

By The Associated Press

New York lawmakers are nearing the end of their 2016 session and it's looking like they will once again fail to address, in any significant way, the wave of corruption that has made Albany one of the nation's most crooked state capitals.

So many lawmakers have been forced from office for alleged misconduct or crimes — including the former Assembly speaker and Senate leader in just the past year — that government reform advocates have taken to calling this Albany's "Watergate moment."

"But all Albany apparently is willing to do is write a parking ticket to the Watergate burglars because they were double-parked," said Blair Horner of the New York Public Interest Research Group.

Instead, lawmakers are divided even on small reforms. A proposal to place a constitutional amendment on the ballot that, if passed, would allow judges to strip the pensions of corrupt lawmakers still hasn't passed, despite support in both chambers. Gov. Andrew Cuomo has proposed tighter campaign finance rules and limits on lawmakers' outside income, but they have little serious support in the Legislature.

Feds Probing Questionable NYCHA Statistics on Lead Tainted Apartments

By Greg B. Smith

When she testified to the City Council in March 2015, NYCHA Chairwoman Shola Olatoye minimized the danger of lead paint in public housing, claiming only 18 apartments had tested positive for lead paint since 2010.

What she didn’t mention was this: In 2004, NYCHA identified more than 55,000 apartments likely to contain lead paint, including more than 10,000 where children younger than 6 live.

Finding the scope and nature of this problem in the nation’s biggest public housing authority is nearly impossible.

And the question of how the New York City Housing Authority addresses this issue is part of an ongoing investigation by the Justice Department.

Peter King: My Sources Say "Ramadan Season" Could Suggest ISIS Planning More Attacks In U.S. Or Europe

The New York Congressman and member of the House Homeland Security Committee says that he has inside sources which suggest that the massacre at a gay nightclub in Orlando may be related to threats from the "Islamic State" terrorist group to attack in the U.S. and Europe during the Islamic holy month of Ramadan. "I do know that things are being looked into the fact that it is the Ramadan season," King said. "I know the European soccer championship [could be under threat] or other events going on around the world.

At Tonys, Performers of Color Win All Musical Acting Categories

Sunday's Tony Awards saw the four major musical acting honors going to people of color, a first in the show’s 70-year history.

The annual celebration of achievement in theater came some 6 months after the Oscar nominations -- which were widely chastised for ignoring the contributions of minority performers.

Cynthia Erivo, Leslie Odom Jr., Renée Elise Goldsberry and Daveed Diggs took home the top trophies at the 2016 Tonys. Erivo won for her starring role in "The Color Purple"; Odom Jr., Goldsberry and Diggs for their work in "Hamilton."

Brexit Could Threaten Western Political Civilization, Says EU’s Tusk

Reuters, 13/06 13:52 CET

BERLIN (Reuters) – If Britons vote to leave the European Union in a June 23 referendum it could be the beginning of the end for the 28-nation bloc and for western political civilisation more generally, European Council President Donald Tusk said.

In an interview with German newspaper Bild, Tusk said a so-called Brexit vote would provide a major boost to radical anti-European forces who he said would be “drinking champagne”.

“Why is it so dangerous? Because no one can foresee what the long-term consequences would be,” Tusk said. “As a historian I fear that Brexit could be the beginning of the destruction of not only the EU but also of western political civilisation in its entirety.”

Everyone in the EU would lose out economically if Britain left, Tusk said.

Iraq Makes Arrests Over Reports of Sunnis Executed in Falluja

Reuters, 13/06 13:09 CET

By Maher Chmaytelli and Ahmed Rasheed

BAGHDAD (Reuters) – Iraq is investigating allegations that Shi’ite militiamen helping the army retake Falluja have executed dozens of Sunni Muslim men from the city held by Islamic State.

The authorities “are following up on the violations and a number of arrests have been made,” government spokesman Saad al-Hadithi said on Monday after a regional governor said 49 Sunni men had been executed after surrendering to a Shi’ite faction.

Suhaib al-Rawi, governor of Anbar province where Falluja is located, said on Sunday that 643 men had gone missing between June 3 and June 5, and “all the surviving detainees were subjected to severe and collective torture by various means.”

The participation of militias in the battle of Falluja, just west of Baghdad, alongside the Iraqi army had already raised fears of sectarian killings.

Falluja is a historic bastion of the Sunni insurgency against U.S. forces that toppled Saddam Hussein, a Sunni, in 2003, and the Shi’ite-led governments that followed.

Cuomo Issues Statement on Orlando Shooting, Orders Additional Security Measures in Key Areas of New York

“I am shocked and saddened by the senseless attack that occurred early this morning in Orlando. On behalf of all New Yorkers, our thoughts and prayers are with the victims, the injured and their loved ones during this unimaginably difficult time. New Yorkers stand in solidarity with the people of Florida, and the LGBT community and I have directed flags at state buildings to be flown at half-staff in the memory of those who were lost in this terrible act of mass murder.

“This is just one more horrific reminder of the need for Congress to pass real and sensible gun safety legislation, just as we did in New York.‎ It is far past time for Washington to act.

"Early reports indicate this was likely an act of domestic terrorism. While there is no specific intelligence that suggests any link between the attacks that occurred in Orlando with New York, out of an abundance of caution, I have directed additional security measures at key points around the state as a precaution. The safety of New Yorkers and our state’s visitors is our number one priority, and we are remaining vigilant and in close contact with local and federal officials and our partner law enforcement agencies."

Division of Homeland Security & Emergency Services

DHSES has been in contact with key local public safety officials following the attacks in Orlando. The DHSES Watch Center, as a precaution, has increased monitoring of various large public gatherings, including various sporting venues throughout the State. DHSES remains in a state of readiness and prepared to disseminate information to our public safety partners statewide as necessary.

State Police & National Guard

The New York State Police and the National Guard have also been in contact with federal officials as well as local law enforcement partners, including the New York City Police Department. At the Governor's direction, as a precaution, the State Police and National Guard have increased surveillance of critical infrastructure including transportation hubs and will be deploying additional resources to large public gatherings.

Port Authority of New York & New Jersey

Port Authority Police are on heightened alert at all of the agency's bridge, tunnel, rail, World Trade Center and other facilities, following the attacks in Orlando. Actions include increased patrols and checks of bags, buses, trucks and trains at agency locations. Travelers are reminded to remain vigilant and report any suspicious activities to police or other authorities.

Metropolitan Transportation Authority

The MTA has increased its patrols and surveillance in order to provide heightened protection across all its agencies. The MTA Police Department has stepped up its uniformed and plainclothes presence in Penn Station and Grand Central Terminal as well as other major stations throughout the Metro-North Railroad and Long Island Rail Road network. Police canine teams and units with heavy weapons will provide extra protection as well as a noticeable sign of increased security. Railroad customers will also see surge patrols, increased step-on/step-off patrols of trains, and random bag checks at various locations.

As always, New Yorkers can report any suspicious activities that may indicate a threat to public safety. Any suspicious activities can be reported to:
